REFUNDS AND RETURNS

REFUNDS AND ORDER CANCELLATIONS

You may cancel the purchase of any order only with our prior written approval. Whenever possible, we will cancel any purchase free of charge.

RETURNS

All returns require our prior written authorization. In such cases, the Customer shall pay the Seller a 25% restocking fee, shipping costs, and reasonable refurbishment costs (if damaged) for all equipment that has been shipped.

MORE INFORMATION ABOUT OTHER ITEMS. INCLUDING PRODUCT WARRANTIES.

These standard terms and conditions of sale ("Terms") apply to the sale of all products and services of PICOS DE EUROPA I. In these Terms, "Seller" means PICOS DE EUROPA I, and "Customer" means the purchaser of tour packages and other related products.

  1. Acceptance of the Seller's Terms and Conditions of Sale. The Customer has read and understands these Terms. The Customer agrees that () the Customer's written acceptance of these Terms (including the issuance of a purchase order by the Customer). (m) the Customer's acceptance of the Seller's services or (iii) Acceptance of these Terms as the sole terms and conditions governing the sale by the Seller to the Customer. The Customer expressly acknowledges and agrees that any terms and conditions proposed by the Customer that are different from or additional to these Terms are unacceptable to the Seller, are expressly rejected by the Seller, and will not form part of the agreement between the Customer and the Seller. No variation of these Terms will be effective unless expressly agreed to in writing by the Seller's chief executive officer or his or her designated representative.
  2. No Consumer Sales. Customer acknowledges that Seller is not in the business of selling without obligation to consumers. Customer warrants and represents to Seller that (a) it is purchasing the ticket, pass, or similar item solely for commercial or business purposes, and (b) it is not a "consumer" as defined by any applicable law or regulation.
  3. Quotations. All quotations are for informational purposes only and do not constitute an offer by the Seller. An order placed by a Customer shall not constitute a contract between the Customer and the Seller unless it has been accepted by the Seller in writing, which acceptance shall be deemed to occur at the Seller's offices in Iquitos.
  4. Prices
    • The prices published are not unconditional offers to sell and are subject to change without prior notice.
    • The seller's stated prices are FOB Point of Shipment and, unless otherwise specified,
    • The Seller's prices do not include any privileges, personal property occupancy, value added, sales, excise, use, revenue, or any other taxes. The Seller may add the amount of any tax to the invoice. The Customer shall be responsible for all such taxes, whether or not billed by the Seller. If a certificate of exemption provided by the Customer is determined to be invalid or if the Customer fails to provide a valid notarized affidavit or any other necessary documentation in a timely manner, any sales tax may be billed.
    • The prices quoted by the Seller are subject to constant change.
    • In the event of late payment, the Seller reserves the right to charge interest at the lower of 15% per month or the highest non-usurious rate permitted by applicable law.
    • The Customer shall have no right of set-off, and the Customer expressly waives and releases any right of set-off, against the money owed to the Seller, any sums claimed or owed to the Customer by the Seller under the contract or any other contract between the Seller and the Customer, including, without limitation, any and all claims for damages.
  5. Payment Terms. All orders are subject to the Seller's evaluation of the Customer's credit. Provided that the Seller, in its sole discretion, deems the Customer to be creditworthy, the standard terms are net 30 days. The Seller reserves the right to refuse and suspend delivery of any order at any time if the Seller determines that the Customer's credit is unfavorable. If the Seller for any reason in its sole discretion feels uncertain about the Customer's willingness or ability to perform, the Seller shall have the unconditional right to demand payment in full prior to delivery.
  6. Late delivery at the customer's request. In the event that the Customer postpones delivery, requests that the Seller suspend the sale, does not provide the Seller with sufficient information to process the Customer's order, or otherwise fails to receive delivery, the Seller shall be entitled, without prejudice to any other rights it may have.
  7. Fees, Force majeure. Non-acceptance.
    • a. Delivery dates are estimates only and time is not of the essence. Although the Seller will use its best efforts to deliver the ticket, pass, or similar item in accordance with the terms of sale, the Seller may, at its sole discretion, cancel or modify all delivery dates, and the Seller shall not be liable to the Customer for any loss of the ticket.
  8. Solvency: Security
    • The Customer declares that the Customer is financially solvent.
    • To secure any unpaid portion of the purchase price or any other debt owed by the Customer to the Seller, the Customer hereby assigns to the Seller and grants the Seller a security interest in the ticket, pass, or similar item. The Customer agrees to execute such financing statements or additional documents, or take any other action that the Seller may reasonably require to perfect such interest, and the Customer hereby appoints the Seller as its attorney-in-fact for the purpose of executing such documents or taking such action.

DATE OF TRANSACTION

For the purposes of this Refund Policy, this refers to the date of purchase of any product or service, which includes the date of processing of any renewal by PICOS DE EUROPA I in accordance with the terms and conditions of the corresponding contract for the product or service.

REIMBURSEMENT PERIOD

You may cancel a product at any time, but a refund will only be issued if you request it from PICOS DE EUROPA I customer service within the refund period specified for the product in question, if available.

NO REFUND AFTER ACCOUNT CLOSURE

If you are eligible for a refund, you must request it before closing your account. You may choose to close your account with us at any time, but by closing your account, you will no longer be eligible for a refund as permitted by this Refund Policy. BRAZILIAN CUSTOMERS. ALL PRODUCTS SOLD BY PICOS DE EUROPA I ARE REFUNDABLE ONLY IF CANCELED WITHIN SEVEN (7) DAYS OF THE TRANSACTION DATE. ANY PRODUCT PURCHASED FROM PICOS DE EUROPA BUT NOT SOLD DIRECTLY BY PICOS DE EUROPA (E.G., PREMIUM DOMAINS) IS NOT REFUNDABLE.

STANDARD REFUND TERMS

One-time purchases: Within 24 hours. Annual plans: Within 30 days of the transaction date. Monthly plans: Within 48 hours of the transaction date.

PRODUCTS WITH SPECIAL REFUND TERMS

Refundable within the first 24 hours if there are no offers.
